A LAWYER has broken down when Walmart customers have to show their receipt, and when it’s okay to walk away.

Attorney Michael Brehne shared that while in most cases retailers like Walmart do not have a right to ask for your receipt, there are specific instances where you can’t ignore the employee.

Brehne (@911brehnelaw), an attorney based in Central Florida explained on TikTok that if they suspect you didn’t pay for something, they could ask for your receipt.

“If they have reason to believe that you [stole something] then they can stop you. But they are not just stopping you to check your receipt, they are stopping you because they have reason to believe you shoplifted,” he explained in the video.

For them to check your receipt they would have had to have seen you shoplift in the store, or not scan an item in self-checkout.

Once they see the customer walk passed the cash registers and toward the exit, they can conduct a shoplifting investigation and ask the customer to show their proof of purchase.

In some states, Walmart can even ban people from the store for not complying.

“In Florida, we have a trespassing statute that is very liberal,” Brehne explained.

“the land owner can say, pretty much for any reason as long as it’s non-discriminatory, that they don’t want you on their property.”

In this case, the customer would have to refuse to leave the store in the presence of an officer, in order to receive a trespassing warning.

Attorney George LaMarche, of LaMarche Safranko Law, told The U.S Sun that he doesn’t advise letting it get to this point, as customers could suffer legal consequences.

LaMarche said: “If that person chooses to come back after being told they are not allowed to shop at the location any longer, they could be charged with trespass.”

The U.S. Sun has reached out to Walmart for comment.
